TERMS AND CONDITIONS OF SALE
In Gauge Ltd
Last updated: 9 September 2026
These Terms and Conditions apply to purchases made from In Gauge Ltd, including purchases made through our website.
Please read them carefully before placing an order.
Nothing in these Terms and Conditions affects your statutory rights as a consumer.
1. About Us
1.1 We are In Gauge Limited, a company registered in England and Wales under company number 08742349.
1.2 Our registered and trading address is:

1.5 In these Terms:
- “we”, “us” and “our” mean In Gauge Ltd;
- “you” and “your” mean the person placing an order with us;
- “consumer” means an individual acting mainly for purposes outside their trade, business, craft or profession;
- “goods” means products supplied by us;
- “services” includes repair, servicing, installation, testing, programming and other work carried out by us.
2. These Terms
2.1 These Terms apply to contracts for goods and services supplied by In Gauge Ltd.
2.2 By placing an order with us, you agree to these Terms.
2.3 Before completing an online order, you will be given the opportunity to review your order and correct any errors.
2.4 A copy of the relevant order information will be provided to you by email or another durable form that you can retain.
2.5 If you are a consumer, nothing in these Terms excludes or restricts any rights you have under applicable consumer law.
2.6 If any provision in these Terms conflicts with a right which the law does not allow us to exclude or restrict, your statutory rights will take priority.
3. Products and Product Descriptions
3.1 We take reasonable care to ensure that product descriptions, photographs, specifications and prices on our website are accurate.
3.2 Images are provided for illustration. Colours, packaging and minor details may differ from those displayed, particularly where manufacturers change packaging or product specifications.
3.3 Dimensions and measurements quoted on our website may be approximate unless stated otherwise.
3.4 Where goods are handmade, 3D printed, customised or otherwise individually produced, minor variations may occur as a natural consequence of the manufacturing process.
3.5 We will not knowingly substitute a materially different product without your agreement.
3.6 If we discover a significant error in the description or price of a product after you have ordered it, we will contact you. You may then confirm the order at the corrected price or description, or cancel it for a full refund.
4. Availability
4.1 All orders are subject to availability.
4.2 Adding an item to your shopping basket does not reserve it.
4.3 If an item becomes unavailable after you have ordered it, we will contact you as soon as reasonably possible.
4.4 Where we cannot supply an item, we may offer:
- an alternative;
- a later delivery date;
- a back-order where appropriate; or
- a refund.
You are not obliged to accept an alternative product.
5. Placing an Order and Formation of the Contract
5.1 Products displayed on our website are an invitation to place an order and do not constitute a legal offer by us to sell them.
5.2 When you submit an order, you are offering to buy the goods or services specified in that order.
5.3 We will normally send an acknowledgement confirming that we have received your order.
5.4 An acknowledgement of receipt does not necessarily mean that we have accepted your order.
5.5 A contract is formed when we expressly accept your order or, where appropriate, when we dispatch the goods or begin providing the agreed service.
5.6 We may decline an order for a legitimate reason, including:
- the goods being unavailable;
- payment not being authorised;
- an obvious pricing or description error;
- delivery restrictions;
- suspected fraud or misuse; or
- us being unable reasonably or safely to provide the requested goods or service.
5.7 Where payment has already been taken for an order that we do not accept, the payment will be refunded.
6. Prices, VAT and Payment
6.1 Prices are shown in pounds sterling unless stated otherwise.
6.2 Prices include VAT where VAT is applicable, unless the website clearly states otherwise.
6.3 Delivery charges are shown separately before you complete your order.
6.4 The total amount payable will be displayed before you place the order.
6.5 We accept the payment methods displayed at checkout.
6.6 Available payment methods may change from time to time.
6.7 Payment must be authorised before goods are dispatched unless we have expressly agreed alternative payment arrangements.
6.8 We will not impose an additional charge merely because you use a particular consumer debit or credit card where such a charge is prohibited by law.
7. Promotions, Discounts and Special Offers
7.1 Promotional offers are subject to any specific conditions stated with the offer.
7.2 Unless otherwise stated, promotional codes cannot be exchanged for cash.
7.3 We may withdraw or amend a promotion before an order is placed.
7.4 Any price reduction or promotional claim made by us will be presented in accordance with applicable consumer law.
7.5 A promotion will not affect your statutory rights.
8. UK Delivery
8.1 Available delivery options and their charges will normally be displayed at checkout.
8.2 We may use Royal Mail or another suitable postal or courier service.
8.3 Unless a particular delivery date has been expressly agreed, delivery dates and transit times shown on our website or by a carrier are estimates.
8.4 We will deliver goods without undue delay and, unless another delivery period has been agreed with you, no later than 30 days after the contract is entered into.
8.5 Your order will be sent to the delivery address supplied by you when the order is placed.
8.6 Please ensure that your delivery address is complete and accurate.
8.7 We are not responsible for delay or non-delivery caused solely by an incorrect or incomplete address supplied by you, although we will take reasonable steps to help recover or redirect an item where possible.
8.8 Some delivery services are untracked. Other services may provide delivery confirmation, tracking and/or a signature.
8.9 The level of tracking or delivery confirmation available depends upon the delivery service selected or used.
The requirement to give delivery arrangements, costs and expected delivery information before a distance sale, and the general 30-day delivery rule unless otherwise agreed, remain part of current UK distance-selling requirements.
9. Delayed, Missing and Lost Deliveries
9.1 If your order has not arrived within the expected delivery period, please contact us as soon as reasonably possible.
9.2 Postal and courier delivery times are normally estimates unless a guaranteed delivery service has expressly been purchased.
9.3 Where an item appears to be delayed, we may ask you to allow the carrier’s published delay or loss-investigation period to expire before a formal carrier claim can be made.
9.4 We may ask you to:
- confirm the delivery address;
- check with other members of your household;
- check any nominated safe place;
- check with neighbours where appropriate;
- contact or check with the relevant local delivery office; and
- provide any information reasonably required to investigate the delivery.
9.5 Where tracking is available, we may use the carrier’s tracking information as part of our investigation.
9.6 Where goods are confirmed or reasonably considered to have been lost in transit, we will provide the remedy required by law, which may include replacement or refund.
9.7 Our right to investigate a delayed or missing delivery does not reduce your statutory rights, including your rights where goods have not been delivered within an agreed or legally required period.
9.8 A carrier’s compensation or loss-claim procedure is an arrangement between us and the carrier and does not replace or restrict your statutory rights against us.
This last point is important: for a consumer order, the seller normally carries the risk until the goods come into the consumer’s physical possession.
10. Ownership and Risk
10.1 Ownership of goods will pass to you when we have received payment in full, subject to any rights arising under applicable law.
10.2 Where you are a consumer, the goods remain at our risk until they come into the physical possession of:
- you; or
- a person identified by you to take possession of them.
10.3 An exception may apply where you independently arrange delivery using a carrier that was not offered by us.
10.4 Nothing in this section affects your rights in relation to goods that are delayed, lost, damaged, faulty or incorrectly supplied.
11. International Orders
11.1 We may accept orders for delivery outside the United Kingdom where the destination is supported by our checkout or separately agreed with us.
11.2 International delivery charges will be shown at checkout where possible. For unusually large, heavy or high-value orders we may contact you with a delivery quotation before accepting the order.
11.3 International delivery times are estimates and may be affected by customs clearance, local postal services and circumstances outside our reasonable control.
11.4 Unless expressly stated otherwise, customers outside the United Kingdom are responsible for any customs duties, import VAT, taxes, clearance charges or similar charges imposed by the destination country.
11.5 Such charges are not normally included in the price paid to us unless expressly stated.
11.6 You are responsible for ensuring that goods you order may lawfully be imported into the destination country.
11.7 Nothing in these Terms is intended to deprive an overseas consumer of mandatory consumer rights that apply in their country and cannot lawfully be excluded.
12. Your Right to Cancel an Online Order
12.1 This section applies where you are a consumer and have entered into a distance contract, for example through our website, by telephone or by email.
12.2 For most goods, you have the right to cancel without giving a reason.
12.3 The cancellation period normally expires 14 days after the day on which you, or a person nominated by you, receives the goods.
12.4 Where one order contains several goods delivered separately, the cancellation period normally runs from receipt of the final item.
12.5 To exercise your right to cancel, you must tell us clearly that you wish to cancel.
You may contact us by:
Email: info@ingaugeltd.com
Telephone: 01905 621 999
or by post to:
In Gauge Ltd
Unit 17c
Top Barn Business Centre
Worcester Road
Holt Heath
Worcestershire
WR6 6NH
United Kingdom
12.6 You may use the model cancellation form at the end of these Terms, but you do not have to use it.
Current Government guidance confirms that distance-sale customers generally have 14 days after receiving goods to notify cancellation and a further 14 days to return them.
13. Exceptions to the Right to Cancel
13.1 The statutory right to cancel does not apply in some circumstances provided for by law.
13.2 These may include, where applicable:
- goods made to your specifications;
- clearly personalised goods;
- goods which by their nature become inseparably mixed with other items after delivery;
- sealed goods which are not suitable for return for health-protection or hygiene reasons once unsealed, where the legal requirements for that exception are satisfied; and
- other goods or services specifically excluded from the statutory cancellation provisions.
13.3 A product will not be treated as personalised or made to specification merely because we normally make or assemble it after receiving an order. The statutory exception will only be relied upon where it genuinely applies.
13.4 Your rights where goods are faulty, misdescribed or otherwise do not conform to the contract are separate and are not removed by these exceptions.
14. Returning Goods After Cancellation
14.1 If you cancel under your statutory right to cancel, you must return the goods to us within 14 days after telling us that you wish to cancel.
14.2 Unless we have agreed otherwise, the customer is responsible for the direct cost of returning unwanted goods following a change-of-mind cancellation.
14.3 This does not apply where:
- the goods are faulty;
- the goods are not as described;
- we supplied the wrong goods; or
- the law requires us to bear the return cost.
14.4 Goods should be returned to:
In Gauge Ltd Returns
Unit 17c
Top Barn Business Centre
Worcester Road
Holt Heath
Worcestershire
WR6 6NH
United Kingdom
14.5 Please include sufficient information for us to identify the order, ideally:
- your name;
- order number;
- address;
- telephone number or email address; and
- reason for return.
14.6 We strongly recommend obtaining proof of posting and using an appropriately insured or tracked service where the value of the goods warrants it.
15. Handling Goods During the Cancellation Period
15.1 You may examine goods to establish their nature, characteristics and functioning in broadly the same way as you could reasonably examine them in a shop.
15.2 Where you handle goods beyond what is reasonably necessary for that purpose and their value is reduced as a result, we may make a deduction from the refund to reflect the actual reduction in value where the law allows us to do so.
15.3 We do not impose an automatic percentage “restocking fee” for exercising statutory cancellation rights.
15.4 This section does not affect separate conditions that may apply to our voluntary 365-Day Returns Policy after statutory cancellation rights have expired.
This is one of the significant changes from your existing terms, which currently provide for a fixed 20% restocking charge. Current Government guidance instead recognises deductions where goods have actually been used or damaged beyond permitted handling.
16. Refunds Following Statutory Cancellation
16.1 Where you validly cancel an online consumer order, we will refund the price paid for the cancelled goods.
16.2 We will also refund the cost of our least expensive standard delivery method offered for the order.
16.3 If you selected a more expensive delivery service, such as an enhanced or express option, we are not required to refund the additional amount above our standard delivery charge.
16.4 We may withhold the refund until:
- we receive the goods back; or
- you provide evidence that you have sent them back,
whichever occurs first, where permitted by law.
16.5 Refunds will be made without undue delay and within the statutory time limits.
16.6 We will normally refund using the same payment method originally used unless otherwise agreed.
Government guidance confirms both the standard-delivery refund requirement and the 14-day refund framework.
17. In Gauge 365-Day Returns Policy
17.1 In addition to your statutory rights, we offer a voluntary 365-Day Returns Policy on qualifying products.
17.2 This additional policy does not replace, restrict or reduce your statutory rights.
17.3 Subject to the exclusions below, qualifying unwanted goods may be returned within 365 days of delivery.
17.4 For a return made under our voluntary policy after the statutory cancellation period has expired, goods must normally be:
- unused;
- complete;
- in a resaleable condition;
- with original packaging where reasonably applicable; and
- supplied with all accessories, instructions, manuals and other items originally included.
17.5 We may reasonably reduce or refuse a refund under this voluntary policy where the condition of the goods means they cannot reasonably be resold as new.
17.6 Unless we agree otherwise, you are responsible for return postage for unwanted goods returned under the voluntary policy after your statutory cancellation period has expired.
17.7 Our voluntary 365-Day Returns Policy does not normally apply to:
- goods made to your specification;
- personalised goods;
- specially modified goods;
- goods which cannot reasonably be resold because of their nature or condition;
- services already performed; or
- items expressly advertised as excluded from the voluntary policy.
17.8 These exclusions apply only to the voluntary returns policy. They do not remove statutory rights relating to faulty, misdescribed or non-conforming goods.
18. Faulty, Damaged or Incorrect Goods
18.1 Goods supplied to consumers must meet the standards required by the Consumer Rights Act 2015, including being:
- of satisfactory quality;
- fit for any purpose made known where the law requires; and
- as described.
18.2 If goods are faulty, damaged, misdescribed or otherwise do not conform to the contract, please contact us as soon as reasonably possible.
18.3 Depending upon the circumstances and the applicable law, you may be entitled to remedies including:
- rejection and refund;
- repair;
- replacement;
- price reduction; or
- a final right to reject.
18.4 The Consumer Rights Act provides consumers with a short-term right to reject qualifying faulty goods, normally within 30 days, subject to the Act’s provisions.
18.5 Rights may continue after the first 30 days, so the end of that period does not mean that your statutory rights have ended.
18.6 Where the goods are faulty or incorrectly supplied and you have a legal right to return them at our expense, we will provide appropriate return instructions or reimburse reasonable return costs as required.
Current Government guidance confirms both the 30-day short-term rejection right and the continuing repair/replacement rights after that period.
19. Graded, Ex-Display and Pre-Owned Goods
19.1 We may sell goods described as:
- graded;
- ex-display;
- refurbished;
- pre-owned;
- used; or
- otherwise not new.
19.2 The product description will identify the known condition of such goods and any material defects of which we are aware.
19.3 The price may reflect the condition, age, packaging or cosmetic appearance of the item.
19.4 You should take the expressly disclosed condition of the item into account when assessing whether it is of satisfactory quality.
19.5 A fault or characteristic clearly disclosed before purchase will not normally make the goods unsatisfactory merely because that disclosed characteristic is present.
19.6 However, graded, used or pre-owned goods remain subject to applicable statutory consumer rights.
19.7 Any additional In Gauge warranty offered on graded goods is provided in addition to, and does not replace or limit, those statutory rights.
This replaces the current wording that could be read as limiting graded-goods rights to 30 days. Your old clause says graded goods are “warranted … for a period of 30 days”.
20. Manufacturer Warranties and Guarantees
20.1 Some products may be supplied with a manufacturer’s warranty or guarantee.
20.2 The terms and duration of any manufacturer’s warranty are determined by the manufacturer.
20.3 A manufacturer’s warranty or any additional warranty offered by us is separate from your statutory rights.
20.4 Your statutory rights against the retailer are not replaced by a manufacturer’s warranty.
20.5 Where In Gauge Ltd acts as an authorised warranty or service centre for a manufacturer, work may also be subject to that manufacturer’s applicable warranty terms and procedures.
21. Repairs, Servicing, DCC and Sound Installation
21.1 We provide repair and technical services which may include:
- locomotive and model railway repairs;
- servicing;
- fault diagnosis;
- DCC decoder installation;
- sound installation;
- decoder programming;
- electrical or mechanical modification; and
- other model railway technical work.
21.2 The exact work to be undertaken will depend upon the instructions provided by you and, where appropriate, our inspection of the item.
21.3 Estimates are based upon the information reasonably available at the time they are provided.
21.4 An estimate is not a fixed quotation unless expressly stated to be one.
21.5 During repair or investigation, additional faults or previously hidden damage may become apparent.
21.6 Where additional work would materially increase the estimated cost, we will normally seek your approval before carrying it out unless you have already authorised expenditure up to an agreed limit.
21.7 We may decline to undertake work which we consider:
- unsafe;
- uneconomic;
- likely to cause disproportionate damage;
- beyond the capabilities or available parts of the model;
- impracticable because of previous modifications or damage; or
- otherwise inappropriate.
22. Customer-Owned Items Sent to Us
22.1 When sending a locomotive, decoder or other customer-owned property to us, you are responsible for packaging it adequately for transit.
22.2 We recommend using a delivery service appropriate to the value of the item and obtaining proof of posting and sufficient transit insurance.
22.3 Please do not send unnecessary accessories, packaging or additional items unless requested.
22.4 When an item arrives, we may record its apparent condition.
22.5 We will take reasonable care of customer-owned property while it is in our possession.
22.6 We are not responsible for:
- pre-existing faults or damage;
- inherent weaknesses in old, brittle or deteriorated components;
- damage that arises unavoidably from reasonable attempts to dismantle, diagnose or repair an item where its construction or existing condition makes such work inherently risky,
provided that we have exercised reasonable care and skill.
22.7 We will not exclude liability where the law does not allow us to do so.
23. Vintage, Fragile and Previously Modified Models
23.1 Older model railway equipment may contain:
- brittle plastics;
- degraded insulation;
- fatigued wiring;
- worn mechanical components;
- obsolete parts;
- weakened adhesives;
- previous repairs or modifications; or
- other age-related defects.
23.2 Such defects may not be apparent until an item is dismantled or tested.
23.3 We will exercise reasonable care and skill but cannot guarantee that every vintage or previously modified item can be safely dismantled or economically repaired.
23.4 If investigation reveals that further work is not reasonably advisable, we may stop work and discuss the available options with you.
23.5 Reasonable diagnostic or labour charges already incurred may still be payable where previously agreed.
24. Parts Availability
24.1 Repair work may depend upon the availability of replacement parts.
24.2 We cannot guarantee the availability of parts for discontinued, vintage or imported products.
24.3 Where a part becomes unavailable, we may:
- offer a suitable alternative where appropriate;
- place the work on hold with your agreement;
- return the item unrepaired; or
- agree another solution with you.
24.4 We will not fit a materially different substitute part without your agreement where this would significantly affect the operation, appearance or value of the item.
25. Repair Times
25.1 Any completion time quoted for repair or installation work is normally an estimate unless expressly agreed as a firm deadline.
25.2 Repair times may be affected by:
- parts availability;
- manufacturer response times;
- workload;
- the discovery of additional faults;
- testing requirements; and
- circumstances outside our reasonable control.
25.3 We will use reasonable care to keep you informed of material delays.
25.4 Nothing in this section removes any statutory rights applicable to the provision of services.
26. Standard of Services
26.1 Where you are a consumer, services will be provided with reasonable care and skill as required by the Consumer Rights Act 2015.
26.2 Where information about the service or its outcome forms part of the contract under applicable law, we will comply with those obligations.
26.3 Where no price has been agreed in advance, you will not be required to pay more than a reasonable price as determined by applicable law.
26.4 Where no completion time has been agreed, the service will be carried out within a reasonable time.
27. Cancellation of Service Contracts
27.1 Consumers entering into certain service contracts at a distance generally have a statutory cancellation period.
27.2 For a qualifying service contract, this normally runs for 14 days from the day after the contract is entered into.
27.3 If you ask us to begin work during that cancellation period, we may ask you expressly to confirm that you wish the work to start.
27.4 If you subsequently cancel after requesting that work start during the cancellation period, you may have to pay a proportionate amount for services already supplied, where the law permits.
27.5 Where a service has been fully performed during the cancellation period, the right to cancel may be lost where the statutory requirements, including the required request and acknowledgement, have been satisfied.
27.6 None of this affects your rights where a service has not been carried out with reasonable care and skill.
28. Collection and Return of Repaired Items
28.1 Once work is complete, we will contact you using the contact details provided.
28.2 Any outstanding agreed charges must normally be paid before an item is dispatched or released.
28.3 Please collect or arrange return of completed items within a reasonable period after notification.
28.4 If customer-owned goods remain uncollected for a prolonged period despite reasonable attempts to contact you, we may give formal notice and exercise any rights available to us under applicable law relating to uncollected goods.
28.5 We will not simply treat customer property as our own merely because it has not been collected.
29. Data and Decoder Settings
29.1 Where we program, reset, update or replace a decoder or other electronic product, existing settings, functions or user-created programming may be altered or erased.
29.2 Please tell us before work begins if particular settings or configurations are important.
29.3 Where reasonably practicable and agreed, we may attempt to preserve or record settings, but we cannot guarantee that existing settings can always be retained where hardware is faulty or requires replacement or reset.
30. Liability
30.1 Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
30.2 In particular, nothing excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- any consumer rights or other liability which cannot lawfully be excluded or restricted.
30.3 If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill.
30.4 We are not responsible for losses that were not foreseeable when the contract was entered into.
30.5 We supply consumer goods and services for private use unless otherwise agreed. If you use them for commercial or business purposes, different rules may apply.
30.6 Nothing in this section limits your statutory rights concerning faulty goods or services.
This is intentionally much narrower than your old liability provisions, which attempted to exclude broad categories of negligence and cap claims at the value of the goods. Current Government guidance warns that terms attempting to avoid responsibility for faulty goods, goods not as described and certain other statutory obligations cannot be enforced against consumers.
31. Business Customers
31.1 If you purchase wholly or mainly for the purposes of a trade, business, craft or profession, you may be a business customer rather than a consumer.
31.2 Statutory consumer cancellation rights do not apply to business-to-business purchases.
31.3 Where you are purchasing on behalf of a business, you confirm that you have authority to bind that business.
31.4 Any specific written terms separately agreed for a business account, trade account, warranty relationship or commercial service will take priority over these Terms where they conflict.
31.5 Nothing in these Terms excludes liability that cannot lawfully be excluded.
32. Events Outside Our Reasonable Control
32.1 We will not be responsible for failure or delay caused by circumstances outside our reasonable control.
32.2 Examples may include:
- severe weather;
- fire or flood;
- strikes or industrial action not involving our own workforce;
- interruption to postal or courier networks;
- transport disruption;
- major telecommunications or power failures;
- government restrictions;
- import or customs delays; or
- unexpected disruption to manufacturers or suppliers.
32.3 Where such an event materially affects an order, we will take reasonable steps to minimise the effect and keep you informed.
32.4 Your statutory rights, including any applicable rights relating to delayed delivery, are not removed by this section.
33. Website Availability and Information
33.1 We take reasonable care to maintain our website and the information displayed on it.
33.2 We cannot guarantee that the website will always be available without interruption or error.
33.3 We may update or change website content where reasonably necessary.
33.4 Changes will not retrospectively alter a contract already entered into unless agreed with you or required by law.
34. Intellectual Property
34.1 Unless otherwise stated, content on our website, including text, graphics, branding, photographs and original designs, is owned by us or used with permission.
34.2 You may view and print website information for your personal use.
34.3 You must not reproduce, distribute or commercially exploit our protected material without permission except where permitted by law.
34.4 Manufacturer names, product names and trademarks remain the property of their respective owners.
35. Personal Information and Privacy
35.1 We process personal information in accordance with applicable data-protection law.
35.2 Information required to process an order or provide a service may be used for purposes including:
- processing payment;
- fulfilling orders;
- arranging delivery;
- providing customer service;
- carrying out repairs or warranty work;
- preventing fraud;
- maintaining accounting and legal records; and
- complying with legal obligations.
35.3 Further information about how we collect and use personal data is set out in our Privacy Policy.
35.4 Our Privacy Policy should be read alongside these Terms but does not reduce your contractual or statutory rights.
I have deliberately removed the old £10 Subject Access Request fee and 40-day response wording. Your old terms still contain both. Current ICO guidance says SARs must ordinarily be handled without a fee and within one month.
36. Marketing Communications
36.1 We will only send electronic direct marketing where we have an appropriate lawful basis to do so.
36.2 Where consent is required, you may withdraw it at any time.
36.3 Marketing preferences do not affect transactional communications necessary to administer an order, repair, warranty claim or other contract with you.
37. Complaints
37.1 We aim to provide a high standard of service.
37.2 If you have a complaint, please contact us first so that we have an opportunity to resolve it.
You can contact:

Telephone: 01905 621 999
37.3 Please provide your order or repair reference where possible.
37.4 We will aim to acknowledge and respond to complaints within a reasonable period.
37.5 Nothing in our complaints procedure prevents you from exercising any statutory rights or other legal remedies available to you.
38. Changes to These Terms
38.1 We may update these Terms from time to time to reflect:
- changes in law;
- changes to our services;
- changes to payment or delivery methods; or
- improvements to our business procedures.
38.2 The Terms that apply to an order are normally those in force when the relevant contract is formed.
38.3 A later change to our website Terms will not retrospectively remove rights forming part of an existing contract.
39. Severability
39.1 Each provision of these Terms operates separately.
39.2 If a court or other competent authority decides that a provision is unlawful or unenforceable, the remaining provisions will continue to apply.
40. No Waiver
40.1 If we do not immediately enforce a right under these Terms, that does not mean that we have waived that right.
40.2 Similarly, exercising one right does not prevent us from exercising another right where available.
41. Third-Party Rights
41.1 Unless expressly stated otherwise, a person who is not a party to the contract does not have the right to enforce these Terms.
42. Governing Law and Jurisdiction
42.1 These Terms and contracts entered into under them are governed by the law of England and Wales.
42.2 If you are a consumer resident elsewhere in the United Kingdom or another country, you may also benefit from mandatory protections provided by the law applicable where you live.
42.3 Nothing in these Terms is intended to deprive a consumer of mandatory rights that cannot lawfully be excluded.
42.4 Consumers may bring proceedings in any court that has jurisdiction under applicable law.
